BHIND, INC. · Legal
Terms of Use
These Terms of Use ("Terms") govern access to and use of bhind.ai and the public materials made available through it by BHIND, INC. By accessing the website, you agree to these Terms. If you use the website for an organization, you represent that you have authority to bind that organization.
At a glance
The important points, before the legal detail.
- These Terms govern the public website, not a separately contracted enterprise service.
- Product access, authorized artifacts, fees, support, confidentiality, data processing, and service commitments require a written agreement or order form.
- Website materials describe BHIND capabilities and typical use cases; customer-specific application coverage, service levels, integrations, and commercial scope are confirmed in the applicable written agreement.
- The website may not be used to interfere with systems, submit harmful material, or violate third-party rights.
1. Company and acceptance
The website is operated by BHIND, INC., a Delaware corporation ("BHIND," "we," "us," or "our"). BHIND's contact address is 131 Continental Dr, Suite 305, Newark, New Castle County, Delaware, United States.
You may use the website only if you can form a binding agreement and your use is lawful. If you do not agree to these Terms, do not use the website. Additional notices or terms may apply to a specific page or resource and will control for that resource if they conflict with these Terms.
2. Website Terms versus enterprise services
These Terms govern the public website and public materials only. They do not by themselves grant access to the bhind product, authorize analysis of an application, create a subscription, establish a support level, or commit BHIND to a feature, delivery date, retention period, security control, service level, or price.
A pilot, inspection, subscription, managed service, or other enterprise engagement must be governed by an accepted order form, master agreement, customer terms, data-processing terms, or another written agreement. If that agreement conflicts with these Terms for the contracted service, the signed agreement controls.
3. Limited website license
Subject to these Terms, BHIND grants you a limited, revocable, non-exclusive, non-transferable right to access and use the website for internal, lawful business evaluation and informational purposes.
This license does not transfer ownership of the website or its content and does not include a right to resell, mirror, frame, systematically extract, or create derivative commercial materials from the website except as permitted by law or written permission.
4. Acceptable use
You are responsible for your use of the website and for information you choose to submit. You may not use the website in a manner that is unlawful, harmful, deceptive, infringing, or disruptive.
- Do not attempt unauthorized access to the website, infrastructure, accounts, data, or non-public product systems.
- Do not probe, scan, overload, disable, evade, or interfere with security, rate limits, access controls, availability, or other users.
- Do not upload or transmit malware, exploit code, unlawful material, secrets, authentication credentials, or data you lack the right to provide.
- Do not use BHIND content or branding to imply sponsorship, certification, endorsement, or affiliation that does not exist.
- Do not use automated means to copy substantial website content except ordinary search indexing or as otherwise permitted in writing.
5. Communications and feedback
If you contact BHIND, you represent that you have the right to provide the information and that it is accurate to the best of your knowledge. Do not send target artifacts, confidential source material, credentials, private keys, payment-card information, government identifiers, or other highly sensitive data through ordinary email unless BHIND has agreed to an appropriate channel.
If you voluntarily provide product feedback or suggestions without a separate confidentiality obligation, BHIND may use them to evaluate and improve its products without restriction or compensation. This does not grant BHIND ownership of your confidential information, customer data, or intellectual property.
6. Intellectual property and trademarks
The website, design, software, text, graphics, visual system, documentation, report interface, and other BHIND materials are owned by or licensed to BHIND and are protected by intellectual-property and other laws. All rights not expressly granted are reserved.
bhind, the bhind mark, and related names and visual elements are BHIND identifiers. Third-party names and marks shown in factual product examples remain the property of their respective owners. Their appearance does not imply affiliation, sponsorship, or endorsement.
7. Product methodology and report limitations
Public product descriptions explain BHIND inspection, monitoring, comparison, alerting, network intelligence, and app content capabilities. The applications, markets, cadence, data sources, integrations, deliverables, and service levels included for a customer are those stated in the applicable written agreement or order form.
Reports may combine application, release, network, content, and monitoring evidence. Findings identify the type and strength of supporting evidence so customers can distinguish technology presence, integration signals, observed activity, and change over time. A signal found in an application does not by itself establish every production behavior or data flow.
Obfuscation, encrypted values, reflection, dynamic loading, server-delivered configuration, native or ahead-of-time code, missing conditional modules, incomplete artifacts, and bounded tool coverage may make an inspection partial. Absence from a report is not proof of non-use.
BHIND reports are technical evidence inputs. Unless a written agreement expressly states otherwise, they are not penetration tests, vulnerability assessments, legal advice, compliance certifications, investment advice, or determinations that an application, service, provider, or organization is secure, compliant, approved, or affiliated with BHIND.
8. Third-party websites and services
The website may link to third-party websites or services, such as scheduling or payment providers. Links are provided for convenience and do not make BHIND responsible for a third party's availability, security, content, terms, or privacy practices.
When you follow an external link, your interaction is governed by that provider's terms and notices. Review them before submitting information or completing a transaction.
9. Website availability and changes
BHIND may modify, suspend, restrict, or discontinue any part of the public website at any time. We do not guarantee that the website will always be available, error free, complete, current, or compatible with every device.
Product descriptions, examples, pricing discussions, and service statements on the website may change and do not create a binding commitment unless included in an applicable written agreement.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLIC WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. BHIND DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
BHIND DOES NOT WARRANT THAT WEBSITE CONTENT IS COMPLETE, ERROR FREE, OR SUITABLE FOR A PARTICULAR DECISION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHIND AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE PUBLIC WEBSITE OR THESE TERMS.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Liability for a contracted enterprise service is governed by the applicable written agreement, not this website section.
12. Suspension and termination
BHIND may restrict or terminate access to the public website if we reasonably believe use violates these Terms, creates security or legal risk, infringes rights, or disrupts the website. Provisions that by their nature should survive—including ownership, disclaimers, liability limitations, and general terms—will survive termination.
13. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory law requires otherwise. Subject to any non-waivable right, courts located in Delaware will have exclusive jurisdiction over a dispute arising from these Website Terms, and each party consents to that jurisdiction and venue.
14. General terms
If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without BHIND's consent; BHIND may assign these Terms in connection with a reorganization, financing, merger, acquisition, or transfer of the relevant business.
These Terms and any notices expressly incorporated into them are the entire agreement concerning the public website and replace prior discussions about that subject. They do not replace a signed enterprise agreement.
15. Changes and contact
BHIND may update these Terms by posting a revised version and updating the effective date. Continued use after the effective date means the revised Terms apply to later use. If a change requires additional notice or consent under applicable law, BHIND will provide it.
Questions about these Terms may be sent to demo@bhind.ai, or by mail to BHIND, INC., 131 Continental Dr, Suite 305, Newark, New Castle County, Delaware, United States.
